Even though most personal injury cases are settled out of court, filing a civil lawsuit occasionally becomes necessary. Dissimilar to a criminal case where the government strives to penalize a criminal for a crime they have committed, a civil lawsuit is court-based. It is the process through which a claimant may take legal action and solicit financial compensation from a respondent who is responsible for some form of negligence.
The majority of personal injury cases come under the umbrella of tort law. Motor vehicle collisions are generally recognized as negligent tort cases, meaning the ensuing injuries and other damages were caused by someone’s accidental negligence.
To begin a civil suit, the claimant has to file a complaint with the relevant court. The complaint must include the reason the complaint is being filed, outline factual and legal reasons the respondent is thought to be liable, and itemize the financial compensation you are seeking.
