Filing a wrongful death claim against a negligent driver in Alabama is different from doing so in another state. Alabama is very restrictive, permitting only punitive damages to be awarded. This financial compensation is not intended to remunerate surviving members of the family for their loss and is not designed to replace the income of the deceased. Instead, the aim of punitive damages is to act as a penalty to deter or otherwise discourage the negligent or malicious act from re-occurring.
When victims lose their lives in accidents caused by the negligent or careless actions of other motorists, it is crucial that their families contact a wrongful death attorney in Alabama at their earliest convenience.
