Bringing a claim of wrongful death claim against someone in Alabama is unique from other states. Alabama is more prohibitive, only allowing punitive damages to be collected. This compensation is not designed to compensate surviving family members for their loss and is not intended to replace the deceased’s income.
Rather, the goal of punitive damages is to punish the negligent or malicious behavior and to dissuade or otherwise deter the negligent or malicious behavior from happening again. A wrongful death claim can only be filed by the personal representative of the deceased.
This could potentially make things financially challenging for the victim’s heirs, but an experienced Alabama wrongful death attorney will know the best way to depict the defendant’s negligence to give you and your family their best opportunity for justice.
